The school council plays an important role in preschool management. The school council’s governance capacity is influenced by many factors, including legal documents. Results of content analysis of current legal documents along with questionnaire survey method with 600 subjects who are school council members and preschool teachers in 6 southern provinces/cities show that: Vietnam's legal document system related to the school governance capacity of the school council still has some limitations. Based on theoretical analysis and current status of relevant policy documents, the article proposes to improve the policy on school governance capacity of preschool councils, which is an important basis for governance capacity. This is an important basis for the school management capacity of the preschool council to have positive changes in the current period.
